1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of gondel.us (the "Site"), operated by Gondel ("Gondel," "we," "us" or "our"). By accessing or using the Site, submitting a form, or requesting a consultation or quote, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Description of Services
Gondel provides custom product development and sourcing services, helping businesses develop, manufacture and import custom products. The Site provides information about these services and allows you to request a consultation or quote. The Site itself does not process payments, sell products directly, or form a binding agreement for goods or services. Any such agreement is established separately, in writing, once a project is scoped.
3. Use of the Site
You agree to use the Site only for lawful purposes and in a manner consistent with its intended use as a business inquiry and information resource. You agree not to:
- Submit false, misleading or fraudulent information through any form
- Attempt to gain unauthorized access to the Site, its systems or related accounts
- Interfere with the Site's normal operation, including through malware or excessive automated requests
- Use the Site to infringe on the intellectual property or rights of any third party
4. Quotes, Consultations and Orders
Information submitted through the consultation or quote forms is used to evaluate your project and prepare a response. Submitting a form does not create a binding order, contract or commitment on the part of either party. Pricing, minimum order quantities, production timelines and delivery terms will be confirmed separately once a project is scoped, and any resulting engagement will be governed by a separate written agreement between you and Gondel.
5. Intellectual Property
The Site's content, including text, graphics, logos and design, is owned by or licensed to Gondel and is protected by applicable intellectual property laws. You may not reproduce, distribute or create derivative works from the Site's content without our prior written consent, except as necessary to view the Site in a standard web browser.
6. User Content and Submissions
When you upload files, artwork, logos, sketches or other materials through a Site form, you represent that you own the rights to that content or have permission to share it, and you grant Gondel permission to use it solely for the purpose of evaluating and, if engaged, executing your project. You remain responsible for the accuracy and legality of any content you submit.
7. Third-Party Links
The Site may reference or link to third-party tools or services (for example, a scheduling tool). Gondel is not responsible for the content, accuracy or practices of third-party services, and your use of them is subject to their own terms.
8. Disclaimers
The Site and its content are provided "as is" without warranties of any kind, express or implied. Gondel does not warrant that the Site will be uninterrupted, error-free or secure. Nothing on the Site constitutes a guarantee of pricing, production timelines, or product outcomes prior to a formal, written project agreement.
9. Limitation of Liability
To the fullest extent permitted by law, Gondel will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or reliance on its content. This limitation does not apply to obligations established under a separate, signed project agreement.
10. Indemnification
You agree to indemnify and hold Gondel harmless from any claims, damages or expenses arising from your misuse of the Site or your violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the United States and the state in which Gondel is organized, without regard to conflict-of-law principles.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
